I'm taking the mature route. All of my future projects will contain the following disclaimer- "Disclaimer: All work from me has the potential to contain loops/samples. Any loops/samples that may be used are royalty-free and legitimately acquired." Furthermore, I will be adding the same disclaimer to my profile page.

You should be aware that uploading a sep from a loop library is most likely a violation of the sellers EULA. Here is the bit from Big Fish Audio for example: "This license expressly forbids resale, rental, loan, gift, or transfer of these samples in any format or via any medium, except as part of a derivative musical work. "

Never thought of that...hmm...I plan to be burying my dirty secrets in a mix and not upload seps of that anyway. Come to think of it, could this be a reason that K3 is private projects with seps hidden to non-accepted collaborators? But what about if you are collaborating on a tune, say using Dropbox and the engineer needs the sep for example? I assume if the Dropbox is not published (same as K3 private project) then its not a violation. The waters are a bit murky...

They specifically do not allow the "transfer" of samples so whether the project is public or private it is still a violation of the license agreement.

interesting. so shipping a daw project as a single project file that includes all parts is OK? (since at that point its derivative work?) but then, say, the engineer decides to extract the samples out of the project? Now what? The waters are murky....again This stuff is handled by lawyers if there is money involved. A lot of "we didn't know where the sample came from", etc...

Here is another bit from the same EULA I cited earlier: "The samples contained herein are licensed, not sold to you, the individual end user, by Big Fish Audio. This non-exclusive, non-transferable license is granted only to the individual end user who has purchased a lawfully made copy of this product from Big Fish Audio or a distributor authorized by Big Fish Audio. All samples remain the property of Big Fish Audio " The point being, you do not have the same rights with samples as you would with something you created yourself. That is why it is not only a mature thing to inform your collaborators it should be required.

What's your goal here? I know how to comprehend license agreements and I've taken time to read them. I'm within every right to use loops/samples in the fashion that I am. Why do you feel the need to cite the EULA? I was trying to go the middle ground and add disclaimer, however, it would seem that it's still not enough.

Let me jump in on this as someone who worked a bit in different roles in the industry. Technically, I believe your collaborator should own a separate license of their own if this is the EULA.

I'm not attacking you. I'm making a general point regarding the use of sample libraries on a music collaboration site. My goal is to make the point that it shouldn't be an option for a person to reveal whether the track they are posting is theirs or not. You aren't the first person to go through this whole sample loop revelation thing. I remember nearly identical posts made by HotJams and Echo Project Studio in the past. These posts about loops seem to be on a loop

You might just start something here Willa man. Not that it's necessary. I wonder how many here don't use those types of tools? Making music is in the mind of the creator, not the tools he or she uses to gain a potentially commercially viable product. I now consider you to be one of my most favored song writers/composers. BZ
